A title policy is a contract of indemnity which compensates the insured against actual monetary loss arising from of title defects, liens, encumbrances and other claims on title. By offering a reimbursement claim against a financially solid title company, in place of a less certain claim under a qualified legal opinion, project funding can be significantly accelerated.

Our title policies will help you close your deals quickly and securely:

Owner’s Title Policy

Covers losses sustained because the real estate is not properly vested in the name of the insured, and also against losses arising from defects, liens and encumbrances on the title to the real estate.

Lender’s Title Policy

Protects against losses arising from various covered risks including, most notably, the mortgage being unenforceable and/or not having the priority stated in the policy.

Single Risk Policy

Covers specifically identified title defects rather than the full range of matters covered by an Owner’s Title Policy. As only specific defects are covered, coverage can be arranged with minimal delay, and the policy language is tailored to the specific defect.

Registration Gap Policy

Covers the insured’s risk against non-registration or intervening claims being registered during the gap period between the date a document is submitted for registration and the date the land court issues its decision concerning registration. By covering the registration risk during the gap period, the policy allows funds to be dispersed earlier, with obvious benefits to the project.

Residential Portfolio Cover

Protects developers against losses arising from title defects that could affect the land on which residential projects are to be developed, which ultimately affect the ownership of the individual apartments. Developers have the option to transfer coverage to the ultimate buyer at closing. This is an application of our Owner’s Title Policy to support residential developers, and the ultimate purchaser of the apartments in multi-unit residential projects.

Key Features of Our Policies

Coverage is provided for a one-time, upfront fee and is valid for as long as the insured owns the property. Should a claim arise, there is no deductible, and a title policy also provides cover for the costs, attorney's fees and expenses incurred in defending title against a covered claim.
